Premise Licence
Premises licences are required in respect of specific premises
where an individual or company proposes to offer premises-based
gambling. Broxbourne Borough Council will licence all premises
where premises-based gambling is undertaken within the Borough,
specifically:
- Casinos
- Bingo Halls
- Betting Shops
- Adult Gaming Centres
- Family Entertainment Centres
- Tracks
As of 1 September 2007 all previous
permissions/licences expired and operators of the above premises
must have the relevant licences as detailed in the Gambling Act
2005. The Council is accepting applications for premises licences
issued under the Gambling Act 2005. The Council also issues

Application process
Applications for a premises licence can only
be made by persons:
· who are over 18
years of age;
· have a right to
occupy the premises;
· who hold, or have
applied for, an operating licence authorising the
proposed
activities.
To apply for a premises licence you are
required to complete and submit the correct application form below
together with the prescribed fee and a scale plan of your premises.

All applications will be treated as new
applications. Grandfather and continuation rights have expired.
New applicants and variation applications
When submitting a new application, or an
application to vary a condition, notification must be given to
various responsible authorities within seven days of the
application being made. The relevant forms are available below and
also on the DCMS website. Interested
parties also require notification. This will enable representations
to be made to the licensing authority. In addition to notices being
sent to responsible authorities notice must also be given in the
following ways:
· Publish a notice
in a newspaper or newsletter of local relevance at least
once within
ten days of the application being made;
· Publish notice
outside the premises in a place where it can be
conveniently
read and is clearly visible.
If no representations are received then the
application can be determined without a hearing. In addition a
hearing is not required if representations are received but they
are subsequently withdrawn or deemed to be frivolous, vexatious
and/or would not influence the determination of the
application.

Conditions
Mandatory conditions are attached to all
licences and these cannot be removed unless further regulations are
passed. Default conditions are attached to all licences except
those for Adult Gaming Centres and Family Entertainment Centres.
Default conditions relate to opening hours only and can be removed
or replaced by the licensing authority. In addition licensing
authorities are able to attach individual conditions to a licence
to ensure that a premises and its operation is reasonably
consistent with the licensing objectives.
