Statement of Licensing Policy

Licensing Policy Review

Under the Licensing Act 2003 the Council is required to develop, consult and publish a statement of licensing policy and review and republish it every five years. The policy details the principles that the Council will adhere to when exercising its licensing functions under the Act.

The current licensing policy for the period 2011-2016 is under the process of review, a revised policy covering the period 2016-2021 will be published in February 2016. The Council is currently seeking views of residents, business and statutory bodies, as part of a consultation exercise.

There are no significant changes proposed in the revised policy other than to take account of changes in legislation since the last policy was produced and changed government guidance. These include the following;

·         Change in the definition of regulated entertainment with regard to live music;

·         The Licensing Authority being a responsible authority;

·         Health Board being a responsible authority;

·         The suspension of licences following non-payment of the annual fee;

·         Changes to Temporary Event Notices (TENs) to include late TENs;

Gambling Policy Review

Under the Gambling Act 2005, the Council regulates the provision of premises for gambling (for example, betting shops, bingo halls, amusement arcades), the provision of gaming machines in clubs and alcohol licensed premises and small society lotteries.

A requirement of the Gambling Act 2005 is that each licensing authority adopts a Statement of Licensing Policy which must be reviewed every three years. This statement sets out the approach the Council will take when determining applications for new licences, variations and reviews. The current statement has been in effect since 2013 and therefore the Council is seeking views of residents, business and statutory bodies, as part of a consultation exercise.

There are no significant changes proposed in the revised policy other than to take account of changes in legislation and changed Gambling Commission guidance. Reference is also made to risk assessments in preparation of the requirements coming into force in April 2016.
