How to Challenge a Penalty Charge Notice

If you wish to challenge the PCN you must to do so in writing.   Please provide full details of why you feel that the PCN was incorrectly issued, or detail any mitigating circumstances you would like to be taken into consideration.

 

Once the Council receives your representation, you will normally receive a full reply within 28 days.

What are the stages of challenging the issue of a PCN?

There are two stages in challenging the the validity of a PCN - an informal Challenge during the first 28 days after issue, and a formal representation thereafter.

  1. Any correspondence received within the initial 28 day period (as an informal challenge) will be considered in line with our policy. If received in the first 14 days (during which the discounted rate applies) we will normally extend the discount period whilst we consider the challenge. If the challenge is accepted, the PCN will be cancelled and a letter sent to the motorist. If more evidence or details are needed, a letter requesting the information will be sent to the motorist (if no information is received within 14 days, the challenge will be rejected). 
  2. If the challenge is rejected, we will send a letter clearly explaining the reason for the rejection. A Notice to Owner (NtO) will be sent to the keeper of the vehicle after 28 days from the date of the rejection letter if the PCN has not been paid.  A formal Representation may then be made using the the NtO. If a representation is not made, the motorist loses any further right to dispute the PCN. The amount due at the time the representation is made will remain the same until it has been responded to. 
  3. If a representation is rejected, the person then has the right to make an appeal to the Traffic Penalty Tribunal, an independent body which has been set up to ensure that unresolved legal disputes between the motorist and Councils can be heard at a formal tribunal hearing. This body is independent of the Council. If you are not satisfied by the outcome of a representation you are entitled to make an appeal to the Traffic Penalty Tribunal.

If payment is not received or representations made with 28 days following a NtO. a charge certificate will be issued.  The  amount due will increase by 50 per cent at this stage.


Please note: Once a ticket has been issued, it cannot be cancelled by a Civil Enforcment Officer, so please do not ask. Threatening behaviour, verbal or physical abuse towards officers will not be tolerated, and will be reported to the police. Please make a representation to the Council who will consider the circumstances of the ticket's issue.
