Persistent Evaders

Broxbourne Council starts the removal of the vehicles of persistent evaders of Penalty Charge Notices.

From 1 March 2011 Broxbourne Council started to remove and impound the vehicles of persistent evaders of Penalty Charge Notices (PCN) under the Traffic Management Act 2004.

 

A persistent evader is defined by the Department for Transport as ‘a vehicle owner who has three or more recorded contraventions for the vehicle and those Penalty Charge Notices have not been paid, represented or appealed against within the statutory time limits, or their representations or appeals have been rejected but they have still not been paid’.

 

In the event that the Council issues a PCN to a vehicle that already has three or more outstanding charges, the vehicle may be removed and impounded. The vehicle will be released upon confirmation of the owner’s current address and payment of the cost of the vehicle removal, any storage charges and the PCN issued at the time of removal. The vehicle removal fee is £105 and the vehicle storage charge from midnight of the day following the removal is £12.

 

The majority of motorists comply with parking restrictions in the Borough and pay PCNs that have been correctly issued. There are however a number of motorists who seek to avoid payment by failing to register keeper details at the DVLA or the details held by DVLA are incorrect. These persistent evaders endanger other users of the highway by obstructing traffic flow and cause inconvenience by reducing the turnover of parking spaces for other motorists. The Council hopes this procedure will discourage residents from parking in contravention and increase the recovery of outstanding PCN charges.
